Terms of service

The deal, in plain words.

These terms cover how you can use RallyNPS, how billing works, and what we each promise. We wrote them to be read, not to hide behind.

The service

RallyNPS is a tool for sending surveys and polls, collecting responses, and reading the results, including AI analysis of comments. You sign up, create a survey, send it to your contacts, and review the scores and themes that come back.

Acceptable use

You are responsible for the people you contact and the messages you send. By using RallyNPS you agree to:

  • Only contact people who agreed to hear from you. No purchased lists, no scraped addresses, no spam.
  • Follow the law. Email surveys must follow CAN-SPAM. SMS and phone surveys must follow the TCPA, including consent and quiet-hours rules. Meeting these rules for your own contacts is your responsibility.
  • Not use the service to harass, defraud, or send unlawful content.

If we see abuse, spam complaints, or illegal use, we may suspend or close the account to protect our contacts, our sending reputation, and other customers.

Billing

  • Paid plans are billed monthly through Stripe.
  • You can cancel anytime. Your plan stays active through the end of the period you already paid for, and it does not renew after that.
  • The free tier stays free within its monthly limits. When you hit a limit, we tell you and you can upgrade to send more.

Rally community share

RallyNPS is part of the Rally group of products. 30% of RallyNPS revenue is shared back with the Rally community. We state this openly because it is part of how the whole group works, not a hidden fee added to your bill.

No warranty, and limits on liability

We work hard to keep RallyNPS running and correct, but we provide it "as is." We do not promise it will never have downtime, bugs, or errors, and we cannot guarantee any particular business result from using it.

To the extent the law allows, we are not liable for indirect or knock-on losses, such as lost profit or lost data. If we are ever found liable, our total liability is limited to the amount you paid us in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of [Andy: confirm state], without regard to conflict-of-law rules. This is the one open item on this page, and it will be set before or just after launch.

Changes to these terms

If we make a material change to these terms, we will email account owners before it takes effect. The effective date at the top of this page always shows the current version.
